Effective date: 1 June 2026

These Terms govern your use of the Funnel Engine platform and website (the "Service"), operated by Sugar & Partners Limited ("Funnel Engine", "we", "us"). By using the Service or joining the waitlist, you agree to these Terms.

1. The Service

Funnel Engine is a reporting automation platform that connects to your marketing platforms, consolidates performance data, and generates dashboards, reports and AI-assisted commentary. Features, plans and availability may change as the Service develops, including during early access.

2. Eligibility and accounts

You must be at least 16 and using the Service for business purposes. You're responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account.

3. Connecting your platforms

When you connect a marketing platform, you authorise Funnel Engine to access the data described in our Privacy Policy on a read-only basis. You confirm you have the right to connect those accounts and to authorise that access, including any client accounts you manage. You remain responsible for complying with the terms of each connected platform (Meta, Google, TikTok, LinkedIn, Reddit and others). You can disconnect any platform at any time.

4. Acceptable use

You agree not to misuse the Service, including: reverse-engineering or copying the platform; reselling or sublicensing access without our agreement; uploading unlawful content; attempting to access data you're not authorised to; or using the Service to breach any connected platform's terms.

5. Your data and our platform

You own your data and the report outputs generated from it. You grant us the limited licence needed to process that data to provide the Service. We own the Funnel Engine platform, software, design and underlying technology; nothing in these Terms transfers our intellectual property to you.

6. AI-generated content

The Service produces AI-assisted commentary and insights. This is generated automatically and may contain errors or omissions. It's provided to support your analysis — you're responsible for reviewing it for accuracy and suitability before relying on it or sharing it with clients or third parties.

7. Fees and early access

Some features may be free during early access. Where fees apply, they'll be set out at sign-up. Early-access features are provided as they develop and may be changed or withdrawn.

8. Availability

We aim for reliable, continuous service but don't guarantee uninterrupted availability. We may modify, suspend or discontinue features, and will give reasonable notice of material changes where we can.

9. Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by law, we exclude implied warranties. We don't warrant that the Service, or any data or commentary it produces, will be error-free or fit for a particular purpose. Where you use the Service for business purposes, the New Zealand Consumer Guarantees Act does not apply.

10. Limitation of liability

To the maximum extent permitted by law, Funnel Engine isn't liable for indirect, incidental or consequential loss, or loss of profit, revenue, data or goodwill. Our total liability for any claim relating to the Service is limited to the fees you paid us in the 12 months before the claim (or NZ$100 if no fees were paid).

11. Termination

You can stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms. On termination, we'll delete your data in line with the Privacy Policy and Data Deletion page.

12. Governing law

These Terms are governed by the laws of New Zealand, and the New Zealand courts have exclusive jurisdiction.
